Geaux Fish Terms and Conditions

1. Your agreement with Geaux Fish
These Terms and Conditions (Terms) govern the Geaux Fish fishing-planning apps for Android and iOS, our business portal, and the supporting website at geaux.fish (the Services). Your agreement is with Geaux Fish Technologies LLC, doing business as Geaux Fish (we, our, or us), operating from Lafayette, Louisiana, USA.
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use them. Our Privacy Policy explains how we handle information. You must be at least 13 to use the Services. If you are under the age of legal majority where you live, a parent or guardian must review and agree to these Terms on your behalf.
2. Fishing plans and guidance
Geaux Fish helps anglers decide what to throw. Choose a body of water, date, fishing window, and target species to receive three fishing presentations based on available conditions and catalog information. Presentations may describe lure or bait, color, size, depth, retrieve, how and where to present it, and when to switch.
The apps also provide waterbody and species information, forecasts, and optional paid planning and follow-up features. Coverage initially focuses on Louisiana and includes selected Texas waters. The mobile planning experience does not require a Geaux Fish account. Features and availability may differ by platform, waterbody, and purchase status.
Recommendations are informational and editorial guidance. AI may help rank presentations, answer plan questions, or draft and structure catalog material. Geaux Fish reviews AI-assisted catalog material before publication and makes the publication decision. Individual plans and chat answers are not necessarily reviewed by a person before delivery.
3. Fishing safety and your responsibilities
Geaux Fish provides informational fishing guidance only. Do not rely on Geaux Fish for navigation, emergency information, weather warnings, or determining whether a body of water is safe to enter.
Geaux Fish is not a marine navigation system, an emergency service, or a weather-warning service. It is not a substitute for official navigation charts or official government fishing regulations. Conditions, water levels, regulations, access, weather, and fish behavior can change rapidly.
You remain responsible for:
- Evaluating actual weather and water conditions, boating and water safety, navigation, safety equipment, and emergency decisions.
- Determining whether an area is safe and accessible and following posted warnings and official advisories.
- Following current Louisiana Department of Wildlife and Fisheries rules and all other applicable fishing regulations, including licenses, seasons, limits, and legal tackle and methods.
- Respecting private-property restrictions, access permissions, closures, and restricted areas.
No recommendation guarantees catching fish, the number, species or size of fish encountered, safety, access, or favorable conditions. Rankings, outlooks, and confidence descriptions are estimates, not catch probabilities or claims of scientific validation or professional field testing.
4. Mobile purchases and subscriptions
Paid features and their price, billing interval, and purchase conditions are shown before purchase. Recurring subscriptions renew automatically until canceled under the applicable store's rules. RevenueCat supports purchase validation, restoration, and access to paid mobile features.
- iOS: Apple processes App Store purchases. Manage or cancel subscriptions through your Apple account, following the store's renewal deadline. Apple handles App Store refund decisions; Geaux Fish cannot approve those refunds on Apple's behalf. See Apple's cancellation instructions and refund process.
- Android: Google Play processes in-app purchases where available. Manage or cancel them in the Google account used for the purchase. Refund requests are subject to Google Play's rules and applicable law; contact Google Play or Geaux Fish support as appropriate. See Google Play's subscription instructions and refund policy.
Cancellation generally stops future renewal while access continues for the paid period, subject to the purchase terms and any refund. Uninstalling the app or deleting its data does not cancel billing. Do not assume a purchase transfers between Android and iOS; use the purchase and restore options available for your platform.
The applicable store's purchase and license terms also apply, including Apple's standard App Store EULA where applicable. These Terms do not override mandatory store or consumer rights. Future price changes are subject to required notice and consent.
5. Business portal and billing
You must have authority to act for a business you apply for or manage. Provide accurate application and listing information, protect your sign-in credentials, assign access only to authorized people, and notify us of suspected unauthorized use. Approval and publication are subject to our review and the Services' requirements.
The business portal supports listings, offers, team access, reporting, and billing. Stripe handles business checkout and recurring subscriptions. Your selected price, billing interval, and benefits are shown before purchase. Business subscriptions automatically renew at the applicable price and interval until canceled. Payment is collected through the agreed payment method or invoicing arrangement. Any separate written business agreement expressly providing different billing terms controls those terms.
- Cancellation: cancel through the business portal's billing tools before your next renewal. Cancellation takes effect at the end of the current paid billing period, and paid benefits continue until then, subject to these Terms. Contact support@geaux.fish if you cannot access the billing tools.
- Refunds: we do not provide prorated refunds for unused time when you cancel. Refunds are available where required by law or to correct billing errors. Contact support about an incorrect or duplicate charge.
- Plan changes: upgrades and downgrades take effect at the next renewal. Your current plan and price remain in effect through the current paid period. We do not apply prorated charges or credits for these changes. Contact support to arrange a plan change before renewal.
Stopping use of the portal does not cancel billing. Consumer App Store and Google Play subscriptions are separate from business billing.
6. Business content, paid visibility, and affiliate links
Businesses retain ownership of submitted content and grant Geaux Fish a non-exclusive, worldwide, royalty-free license to host, format, reproduce, and display it as needed to operate their authorized listings and offers. Businesses must have the necessary rights to their submitted material, provide accurate claims and terms, honor their offers, and comply with applicable advertising and consumer-protection laws.
Fishing-related businesses, including tackle and bait shops, marinas, boat launches, guides, lodging, restaurants, and other trip services, may pay for visibility, listings, promotions, offers, or sponsorships. Paid or sponsored placements should be identifiable where appropriate. Payment does not determine the underlying fishing recommendation, its order, or confidence.
Geaux Fish may earn a commission when you purchase through certain links. This does not affect our fishing recommendations.
7. Retailers, maps, and other third parties
The Services may display third-party products and information or link to retailers, business offers, maps, and other websites or apps. Third-party products are controlled by their sellers and manufacturers. Prices, availability, specifications, inventory, and offers may change.
Subject to the non-waivable rights below, Geaux Fish is not responsible for third-party websites or transactions, product quality, fulfillment, warranties, returns, or third-party information. Review the provider's terms and policies before using its service or purchasing. A product's appearance in our catalog does not imply its manufacturer endorses or is affiliated with Geaux Fish.
Maps and directions opened through the apps are subject to the relevant map provider's terms. A map, coordinate, business listing, or link does not establish legal access, current conditions, or safe navigation.
8. Permitted use and intellectual property
Subject to these Terms, you may use the Services for their intended fishing-planning or authorized business purposes. You may not bypass access or payment controls, interfere with security, introduce malware, overload the Services, manipulate reporting, impersonate another person or business, or submit unlawful or infringing material. You may not copy, resell, reverse engineer, or commercially exploit the Services except as permitted by law or our written agreement.
Geaux Fish branding, application design, proprietary recommendation logic, written fishing guidance, original catalog and editorial content, software, graphics, and other original materials belong to Geaux Fish or its licensors to the extent protected by law. Third-party product names, company names, trademarks, manufacturer marks, and materials remain the property of their respective owners.
9. Availability and ending use
You may stop using the Services at any time. We may change or discontinue features or reasonably restrict access to address violations, fraud, security issues, legal obligations, or risks to people or property. We will provide notice and remedies where required by law or applicable purchase terms. Stopping use does not by itself cancel a subscription.
Terms that by their nature continue after use ends, including ownership, lawful liability limits, and dispute provisions, remain effective.
10. Warranties and liability
To the extent permitted by law, the Services are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant uninterrupted or error-free service, complete or accurate fishing and weather information, or suitability of a location, presentation, product, or offer for your circumstances.
No disclaimer, exclusion, cap, or other provision in these Terms limits liability for physical injury, intentional or gross fault, or any liability or consumer right that cannot lawfully be excluded or limited, including under Louisiana Civil Code article 2004.
Subject to those exceptions and only to the extent permitted by law, Geaux Fish and its personnel are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or business opportunities arising from the Services. Their total aggregate liability for claims relating to the Services is limited to US $100. These limits concern the Services, including fishing and weather information, maps, water access information, affiliate products, and business listings, and do not override the exceptions above.
11. Business responsibility for third-party claims
To the extent permitted by law, a business using the portal agrees to defend and indemnify Geaux Fish against third-party claims and reasonable costs arising from that business's infringing or unlawful submitted content, misleading offers, fulfillment failures, or violations of these Terms or applicable law. This provision does not apply to individual consumer use or require indemnification for Geaux Fish's own fault or unlawful conduct.
12. Disputes and Louisiana law
Louisiana law governs these Terms, except where federal law or mandatory law applicable to you requires otherwise. Before arbitration, send written notice to support@geaux.fish; both parties will attempt to resolve the dispute in good faith for 30 days.
If unresolved, either party may initiate individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. Arbitration may take place in Louisiana, remotely, or at another mutually agreed location. Geaux Fish will pay fees the arbitrator determines would be excessive for a consumer. Either party may bring an eligible individual small-claims action or seek urgent injunctive relief concerning intellectual-property misuse or security.
To the extent permitted by law, arbitration proceeds individually, without class, collective, consolidated, or representative proceedings. A claim for which that waiver is unenforceable proceeds in court. You may opt out of arbitration by emailing support within 30 days of first accepting these Terms, identifying yourself and stating your decision. Opting out does not affect access to the Services.
Claims outside arbitration must be brought in a state or federal court with jurisdiction in Louisiana, except where applicable consumer law does not permit that venue.
13. Changes and general terms
We may revise these Terms as the Services or law changes. We will post the revision date and give additional notice or obtain consent where required. Changes to arbitration apply prospectively unless law permits otherwise. Continued use after revisions take effect constitutes acceptance only where allowed by law.
These Terms and applicable purchase conditions govern your use unless a separate written agreement applies. If a provision is unenforceable, the remainder continues to the extent permitted by law. Failure to enforce a provision is not a waiver. You may not assign this agreement without our consent; we may assign it in connection with a reorganization, merger, acquisition, or sale of the business, subject to applicable law.
